Terms of use.

We know that most terms of use are written in legalese that are hard to understand and even harder to get through. That's why we decided to keep things simple and straightforward with a list of bullet points that cover the key points you need to know when using our website and online services. No jargon, no confusion – just the facts.

So, without further ado, here's what you need to know:

General

  • By using CoLab (also referred to as "we", "us", or "our"), our users (also referred to as "you" or "your") agree to be bound by these terms of use (“Terms”). If you do not agree to be bound by all of these Terms, then please do not access or use our website or services.

  • We may update these Terms from time to time. Whenever we make a significant change to our policies, we will also announce them on our blog or via email. However regardless of the change, you are always agreeing to abide by our current Terms, whatever they are.

  • If you violate any of these Terms, we may terminate your use of our online services.

  • You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

    Free 30-minute consults

  • We offer you the ability to schedule a free 30-minute call via our website. While we certainly endeavour to make ourselves available for all calls scheduled, we won’t be held responsible if for some reason we fail to fulfil this. We also cannot guarantee that this scheduling tool will always work as intended, or be available at all times (as it is powered by a third-party platform).

    Subscriptions

  • Unlimited scheduled consultations offered in subscription packages are subject to reasonable use. We will be the sole decision maker in deciding what constitutes reasonable use.

    Accuracy of Information

  • Information found on our website is accurate as of the time of publishing. While we try to keep this information as up to date as possible, we accept no responsibility if we fail to do so. Things move quickly, particularly in the field of planning.

    Passwords

  • Account security is a two-way street. We do all we can to protect this information from our end, and expect that you do the same on your end. If your password is “hello123” and you use this for all your accounts, then that’s on you if your account is breached.

    Intellectual Property

  • All content on our website, including text, graphics, logos, images, and software, is the property of CoLab Planning or its licensors and is protected by copyright and other intellectual property laws. You are not allowed to use any of this content for commercial purposes without the express written consent of CoLab Planning.

    Disclaimer of Warranties

  • We do not guarantee the accuracy, completeness, or reliability of the information on our website. We are also not responsible for any errors or omissions on the website, or for any damages or losses that may arise from the use of the website or the reliance on any information contained on the website.

    Limitation of Liability

  • We will not be liable for any damages or losses that may arise from the use of its website or the reliance on any information contained on the website. This includes, but is not limited to, indirect, incidental, consequential, special, or punitive damages. We will also not be liable for any loss or damage arising from the failure of its website or services to operate as intended, including website downtime or unavailability. By using our website and online services, you acknowledge and agree that you are using our website and services at your own risk and waive any claims for damages or losses that may arise from your use of our website or services. While we will make efforts to address any issues that may arise, we cannot guarantee that all problems will be resolved to your satisfaction.

    Indemnification

  • By using our website and online services, you agree to indemnify and hold CoLab Planning and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the website, your violation of these terms of use, or your infringement of any intellectual property rights.

    Governing Law

  • These terms of use and any disputes arising out of or in connection with these terms of use will be governed by the laws of New Zealand. The courts of New Zealand will have jurisdiction over any such disputes. In the event of a dispute, CoLab Planning and yourself will first attempt to resolve the dispute through methods such as mediation or arbitration, before resorting to court proceedings.

    Miscellaneous

  • These terms of use constitute the entire agreement between CoLab Planning and the user and supersede any prior agreements or understandings, whether written or oral. CoLab Planning reserves the right to amend these terms of use at any time, and any such amendments will be effective upon posting on the website. If any provision of these terms of use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Disputes arising out of or in connection with these terms of use shall be resolved by the courts of New Zealand, with a preference for dispute resolution methods such as mediation or arbitration.

That’s it for now! If you have any questions about these Terms of Use, please contact us.
